These Terms of Service ("Terms") govern the use of the internal server backup application ("the Application") operated by The Americas Consulting Company ("we", "us", or "our"). By using or authorizing the Application, you agree to these Terms.
The Application is an internal, automated backup tool that creates encrypted archives of server data and uploads them to a designated Google Drive folder via the Google Drive API. It is not a public-facing service and is operated exclusively for internal infrastructure management purposes.
The Application is authorized and operated solely by The Americas Consulting Company. It is not made available to external users, clients, or the general public. Use of the Application is restricted to authorized personnel of the organization.
The Application uses Google Drive API Services. By authorizing the Application to access a Google account, the account holder acknowledges that such access is governed by the Google APIs Terms of Service in addition to these Terms. The Application's use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
The Application uploads only encrypted backup archives to Google Drive. It does not access, read, modify, or delete any files outside the designated backup folder. All data is encrypted before leaving the organization's server. No third-party personal data is processed by the Application.
All backup content uploaded via the Application belongs to The Americas Consulting Company. No intellectual property rights are transferred to any third party by virtue of storage on Google Drive.
The Application is provided for internal operational use. We make no warranties, express or implied, regarding availability, reliability, or fitness for any particular purpose beyond its described backup function. We are not responsible for data loss resulting from Google Drive service interruptions or third-party infrastructure failures.
To the maximum extent permitted by applicable law, The Americas Consulting Company shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Application or Google Drive services.
We reserve the right to modify these Terms at any time. The effective date at the top of this page reflects the date of the most recent revision. Continued use of the Application after a revision constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Oriental Republic of Uruguay, without regard to its conflict of law provisions.
